These terms and conditions apply to all transactions on this site and are to be read in conjunction with our standard terms and conditions.
These terms and conditions apply to the use of this website and by accessing this website and/or placing an order you agree to be bound by these terms and conditions. If you do not agree to be bound by these terms and conditions you should not use or access this website further.
This site is owned and operated by Geographe Enterprises Pty Ltd trading as ‘Geographe’. Within this site, Geographe Enterprises Pty Ltd may be referred to as 'Geographe Enterprises' or 'Geographe' or 'we' or 'us' or 'our'.
The Contract Between Us
Any contract for purchases made through the website will be with Geographe. Geographe must either receive payment of the whole of the price for the goods that you order via credit or debit card before your order can be accepted, or via a purchase order against a previously credit checked account.
Once payment has been received, Geographe will confirm that your order has been received by sending an email to you at the email address you provide in your registration form. The order confirmation email will include your name, the order number and the total price. Geographe’s acceptance of your order brings into existence a legally binding contract between Geographe and the transacting entity on these terms. Any term sought to be imposed by you in your order will not form part of the contract.
Geographe is entitled to withdraw from any contract in the case of errors or inaccuracies regarding the goods appearing on our website. If an error or inaccuracy is discovered with regards to the advertised price of the goods that you have ordered, we will contact you prior to acceptance of order. This will be to inform you of the correct price of the goods, and to ask you if you wish to continue or not with the order at the amended price.
In the event there should be unreasonable delays in expected delivery timeframes, Geographe will contact the transactor to discuss alternative options.
These terms and conditions and all transactions relating to this website are governed by Australian law and are subject to the non–exclusive jurisdiction of the Australian courts. We do not accept amendments to these terms and conditions.
Additional terms and conditions may apply for our value-added services and offers. If so, you will be alerted to them at the relevant juncture.
These terms and conditions only cover the Geographe Online Store website (store.geographe.com.au). Any other websites which are linked to from this site are governed by their own terms and conditions. We accept no responsibility or liability for the content or operation of websites, which are not under our control. We are required by law to tell you that sales can be concluded in English only and that no public filing requirements apply.
Geographe own the copyright, trademarks and other intellectual property rights in all material and content on this website, which you may use, download, copy or otherwise make available by any other means only for your own personal, non–commercial use. Any other use or reproduction of the material or content is strictly prohibited.
While we will use reasonable endeavours to verify the accuracy of any information we place on the Geographe website, we make no warranties, whether express or implied in relation to its accuracy.
We make no warranty that the Geographe website will meet your requirements or will be uninterrupted, timely or error–free, that defects will be corrected, or that the site or the server that makes it available are free of viruses or bugs or represents the full functionality, accuracy, and reliability of the website.
We will not be responsible or liable to you for any loss of content or material uploaded or transmitted through the Geographe website.
Customer Accounts and Personal Information
Geographe have the right to accept and decline account applications at their discretion.
Geographe have the right to refute or suspend an account at any time without prior warning should the account holder be deemed to be using the site illegitimately.
The information contained within the personal login / accounts page is used for the purposes of online browsing/purchasing and will not be disclosed to any third parties for their online or mail distribution list or otherwise.
Passwords are automatically generated, or chosen by the account holder unless requested otherwise. All passwords except in the latter case are encrypted and not retrievable by Geographe personnel.
Through SSL encryption, credit card information is transmitted, providing a secure method of payment.
Geographe accepts payment by Visa, MasterCard, American Express or by prior arrangement, a purchase order. All product prices are shown in $AUD and exclude GST. Your payment card company will perform any currency conversion required should you be outside of Australia.
Upon receiving your order Geographe, carries out a standard pre-authorisation check on your payment card to ensure there are sufficient funds in order to complete the transaction. No payment is debited from your card during this pre-authorisation check. Your card will only be charged immediately prior to dispatch of the items in your order. Items not dispatched, will not be charged to your card.
Payment accepted via purchase order will invoke terms previously agreed with Geographe with regards to credit and payment period.
Freight Preferences and Delivery Charges
All new account holders will be contacted to discuss their freight preferences at the time of their first purchase. All Freight and Delivery charges are shown on the website in $AUD and includes 10% GST.
Availability of Goods You Order
If Geographe has insufficient stock to deliver the goods ordered by you, we will notify you as soon as possible to discuss alternative arrangements.
Our Warranty Policy is simple: if it fails within the warranty period we'll replace it, or fix it without question.
We do of course reserve the right to charge for repairs or replacements in the event that subsequent investigation shows that the failure was not due to faulty materials or workmanship; if in other words, the failure was due to lack of maintenance, overload, accidental damage, abuse, normal wear and tear, or any other factors beyond our control.
The warranty period for new parts is 12 months from the date of delivery, or the standard industry expected life of the product and is covered for workmanship and material.
1. All stocked parts returned;
a) within seven (7) days – full credit
b) After seven (7) days and up to four (4) weeks – 15% restocking fee applies unless proven faulty, defective or incorrectly supplied by Geographe
c) After four (4) weeks – no credit given
2. Parts that are not part of Geographe’s normal stock inventory and have been manufactured or externally sourced by purchase or sub-contract that are not faulty, defective or otherwise non-conforming to the Customer’s orders will not, under any circumstances be accepted for credit.
3. Parts must not have been fitted or otherwise used.
4. Custom-made parts specifically ordered to meet Customer requirements not accepted for credit.
5. A copy of our original invoice or delivery docket MUST accompany goods.
6. Freight costs on parts returned for credit for any reason other than faulty parts, parts under warranty or incorrect supply by Geographe are the customer’s responsibility.
7. All parts returned are at the customers' risk.
Changes to This Agreement
Geographe reserves the right to make changes to our site, policies, and these terms and conditions at any time. If any of these conditions shall be deemed invalid, void, or for any reason unforeseen, that condition shall be deemed severable and shall not affect the validity and enforceability of any remaining condition.
